1 Acceptance of Terms

By accessing and using InstaFactu, you agree to be bound by these terms and conditions of use. If you do not agree with any part of these terms, you should not use our service.

2 Service Description

InstaFactu is a digital invoicing platform that allows users to create, manage and send invoices professionally and efficiently.

IMPORTANT: Tax Regulation Limitations

InstaFactu does NOT comply with Spanish tax regulations (SIF/Verifactu)

This service CANNOT be used by:

  • Companies with tax residence in Spain
  • Freelancers subject to Spanish tax obligations
  • Any entity that must comply with the Invoice Information System (SIF)
  • Users who require Verifactu compliance

Using this service for invoicing in Spain may result in tax penalties.

3 User Declarations and Geographic Restrictions

Mandatory User Declaration

By registering and using InstaFactu, the user expressly declares that:

Is NOT subject to Spanish tax regulations or SIF (Invoice Information System) obligations
Will NOT use InstaFactu to issue invoices under Spanish tax regulations
Does NOT require Verifactu compliance for their commercial activities
Understands that InstaFactu actively blocks the creation of issuers with tax residence in Spain

Consequences of Non-Compliance

The user acknowledges and accepts that:

  • • Improper use of this service for invoicing in Spain may result in serious tax penalties
  • • InstaFactu is not responsible for legal consequences arising from incorrect use of the service
  • • We reserve the right to suspend accounts that violate these restrictions

7. Intellectual Property

InstaFactu and all its content, features and functionalities are owned by our company and are protected by copyright, trademarks and other intellectual property laws.

8. Privacy and Data Protection

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these terms. We comply with GDPR and all applicable regulations outside of Spain.

9. Service Availability

We strive to keep the service available 24/7, but we do not guarantee 100% uptime. We may perform scheduled maintenance with prior notice.

10. Limitation of Liability

InstaFactu is provided "as is". We will not be liable for indirect, incidental, special or consequential damages resulting from the use of the service.

11. Modifications to Terms

We reserve the right to modify these terms at any time. Modifications will take effect immediately after publication.

12. Termination

We may suspend or terminate your access to the service in case of breach of these terms. You may cancel your account at any time.

13. Applicable Law

These terms are governed by applicable international laws. Disputes will be resolved through international arbitration.
